Terms & Conditions

The agreement between Goldy Motors and every passenger, visitor and customer who uses our website, our booking lines or travels on our buses.

Plain-English summary.By booking a seat on, or travelling with, Goldy Motors, you agree to: arrive on time, carry valid ID, behave respectfully, and follow our crew's safety instructions. We'll do everything reasonable to run on schedule and keep you safe. Cancellations and refunds follow our Refund & Cancellation Policy. Any disputes are governed by Indian law and the courts of Shahjahanpur, Uttar Pradesh.

These Terms & Conditions ("Terms") govern the relationship between Goldy Motors, with its principal place of business at Tempo Stand near Durga Hotel, Shahjahanpur, Uttar Pradesh, India ("Goldy Bus", "we", "us", or "our"), and you, the visitor, passenger, customer, agent or partner who accesses our website, contacts our booking lines, or travels on any of our bus services ("you", "your" or "Passenger").

This document is an electronic record in terms of the Information Technology Act, 2000, and the rules thereunder, and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. Being an electronic record generated by a computer system, it does not require any physical or digital signatures. It is published in accordance with Rule 3(1) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, requiring publication of the rules and regulations, privacy policy and terms of use governing the access or usage of our Platform.

1. Acceptance of Terms

By accessing or using our website, booking a seat through any channel (online, telephone, WhatsApp, counter or authorised agent), or boarding any of our buses, you confirm that you have read, understood and unconditionally agree to be bound by these Terms, our Privacy Policy and our Refund & Cancellation Policy, each of which is incorporated into these Terms by reference. If you do not agree, please do not use our Services.

ACCESSING, BROWSING OR OTHERWISE USING THE PLATFORM, OR BOARDING ANY OF OUR BUSES, INDICATES YOUR AGREEMENT TO ALL THE TERMS AND CONDITIONS UNDER THESE TERMS OF USE. PLEASE READ THESE TERMS CAREFULLY BEFORE PROCEEDING.

2. Definitions

  • "Booking" means a confirmed reservation of one or more seats on a Goldy Bus departure.
  • "Departure" means a scheduled run of a Goldy Bus, including the AC service (UP27CT9292 / UP27CT9494), on the Powayan ↔ Delhi route.
  • "Fare" means the amount payable for the seat or sleeper, exclusive or inclusive of taxes as stated at the time of Booking.
  • "Platform" means our website, any mobile-optimised version of it, our official WhatsApp and SMS channels, and any future application published by Goldy Motors.
  • "PNR" means the Passenger Name Record or ticket reference number issued upon successful Booking.
  • "Crew" means our drivers, conductors, counter staff, supervisors and managers.

3. Eligibility

You must be at least eighteen (18) years of age and competent to enter into a binding contract under the Indian Contract Act, 1872, to make a Booking. By making a Booking, you represent and warrant that you meet this requirement. Persons under eighteen (18) may travel only when booked by a parent, legal guardian or accompanying adult who has accepted these Terms on their behalf.

Booking on behalf of a group is permitted, but you confirm that you have authority from each member of the group to provide their personal details and accept these Terms on their behalf.

4. Account & Booking Information

To complete a Booking, you may be required to provide accurate and complete information including your name, gender, age, mobile number, boarding point, drop-off point and, where applicable, identification details for statutory checks. You agree:

  • to provide true, accurate, current and complete information at the time of Booking and to keep that information up to date;
  • to be solely responsible for the accuracy of details such as the travel date, route, bus type, boarding point and Passenger names;
  • to safeguard your PNR, ticket and any one-time password (OTP) sent to you, and to take responsibility for activity carried out using them;
  • to inform us promptly of any unauthorised use of your Booking or credentials.

We reserve the right to cancel any Booking made with information that we reasonably believe to be false, fraudulent or misleading, with or without prior notice and without liability beyond a refund of the amounts actually received.

5. Booking Process

A Booking with Goldy Bus follows broadly the steps below:

  1. you select a route (Powayan → Delhi or Delhi → Powayan), a date and a bus and indicate the number of Passengers;
  2. you choose a seat or sleeper from the live bus layout, and provide the required Passenger details;
  3. you make payment of the applicable Fare through our payment gateway, currently PhonePe;
  4. on successful payment authorisation, you receive an electronic ticket bearing a PNR via WhatsApp / SMS / email, which serves as confirmation of the Booking.

A Booking is only confirmed upon receipt of the electronic ticket. A payment in transit, a debit on your bank statement, or a screenshot of a successful payment, is not by itself confirmation of a Booking. If you have been charged but have not received a ticket, please contact us immediately.

6. Fares, Charges & Payment

Fares are quoted in Indian Rupees (INR) and are the same irrespective of the boarding point on the route, unless stated otherwise. Indicative fares for our two services are:

We reserve the right to revise Fares from time to time without prior notice. The Fare displayed at the time of Booking is the Fare you will pay. Applicable taxes, levies and convenience charges, if any, will be itemised before payment.

Payments are processed by our payment gateway. We do not store full card or UPI credentials. If a Booking fails after a payment has been debited, the amount will normally be reversed by the gateway within a few business days. If it is not, please contact us with your transaction reference and we will assist with the reversal in line with our Refund Policy.

7. Tickets, ID Proof & Boarding

  • Tickets are issued electronically. You may either present the ticket on your mobile device or carry a printed copy.
  • Each Passenger must carry a valid government-issued photo identification (Aadhaar, voter ID, driving licence, passport or similar) and present it for inspection on demand.
  • Passengers must arrive at the boarding point at least fifteen (15) minutes before the scheduled departure. The bus may not be able to wait for late arrivals once the scheduled departure time has passed.
  • Boarding is only permitted at the points listed for your selected route. Mid-route requests for unscheduled stops cannot be accommodated.
  • Each Booking entitles the Passenger to the specific seat or sleeper allocated. Seat changes en route may be permitted by the Crew at their discretion, subject to availability and operational safety.

8. Luggage & Personal Belongings

  • Each Passenger may carry one piece of cabin luggage of reasonable size and one piece of checked luggage in the bus' underbelly compartment, subject to space availability.
  • Excess, oversized or unusually heavy luggage may be refused, or charged additionally at the Crew's discretion.
  • Passengers are solely responsible for the safe custody of their belongings, valuables, electronics, jewellery, documents and cash. Goldy Motors is not liable for loss, theft or damage to such items, except where caused by gross negligence attributable to us.
  • Lost-and-found items recovered from the bus will be retained for a reasonable period and may be returned to the rightful owner upon adequate proof of ownership and reimbursement of any handling cost.

9. Passenger Conduct

To ensure a safe and comfortable journey for everyone, every Passenger agrees to:

  • obey instructions of the Crew, including those relating to seating, boarding, alighting and emergencies;
  • keep noise to a reasonable level, particularly during overnight sectors, and refrain from playing audio without headphones;
  • keep the bus clean and refrain from littering, spitting or damaging seats, curtains, fittings or fixtures;
  • wear footwear, dress decently, and behave with civility towards co-passengers and Crew;
  • stay seated while the bus is in motion and use seatbelts or sleeper restraints where provided.

Damage to the bus, its fittings or its property, caused intentionally or through gross negligence by a Passenger, may be recovered from that Passenger, in addition to any criminal liability that may arise.

10. Prohibited Items & Activities

The following items and activities are strictly prohibited on board our buses and at our boarding points:

  • firearms, explosives, ammunition, fireworks, flammable liquids and any other hazardous or dangerous goods;
  • illegal drugs and any narcotic or psychotropic substance prohibited under Indian law;
  • consumption of alcohol or smoking (including e-cigarettes and vaping) inside the bus;
  • live animals other than service animals required by Passengers with disabilities, with prior intimation;
  • perishable items of strong odour, large containers of cooked food, or items likely to disturb other Passengers;
  • harassment, abusive language, threatening behaviour, indecent exposure or any form of conduct that endangers or offends other Passengers or Crew.

Goldy Motors reserves the right to off-board, refuse carriage or hand over to law-enforcement authorities any Passenger found to be in breach, without refund and without further liability.

11. Changes, Cancellations & Refunds

Cancellations, modifications and refunds are governed by our Refund & Cancellation Policy, which forms an integral part of these Terms. Please review that document before making a Booking. The applicable cancellation charge depends on how far in advance of the scheduled departure the cancellation is made.

12. Schedules, Routes & Stops

The published schedule, including departure times, stops and arrival times, is indicative. Actual running times may vary on account of traffic, road conditions, weather, regulatory checks, mechanical factors or other circumstances beyond our reasonable control. We will make reasonable efforts to operate as close to the published schedule as possible.

Goldy Motors may, where reasonably necessary, alter, advance or delay a departure, change boarding or drop-off points, combine or split services, or substitute a different vehicle of similar standard (including replacement of an AC bus by another bus of comparable class). Where any such change materially affects your Booking, we will notify you using the contact details on your Booking and will, where applicable, offer rescheduling or a refund in line with our Refund Policy.

13. Force Majeure

Goldy Motors shall not be liable for any failure or delay in performing its obligations under these Terms, or for any loss or damage arising therefrom, to the extent such failure or delay is caused by an event beyond its reasonable control, including without limitation:

  • acts of God, floods, earthquakes, storms, fog or other adverse weather conditions;
  • road accidents not attributable to us, road blockades, protests, riots, strikes or civil disturbance;
  • government action, curfews, lockdowns, regulatory orders, epidemics or pandemics;
  • fire, mechanical breakdown, fuel shortage or supply failure;
  • acts of war, terrorism or sabotage; or any other event of force majeure recognised under Indian law.

In such situations we will, where possible, arrange an alternative service or a refund in line with our Refund Policy.

14. Liability & Limitations

Without prejudice to our statutory obligations under the Motor Vehicles Act, 1988, the Carriage by Road Act, 2007, and other applicable law:

  • our maximum aggregate liability to any Passenger arising out of or in connection with a Booking, whether in contract, tort, negligence, statute or otherwise, shall not exceed the total amount of the Fare paid by that Passenger for the Booking concerned;
  • we shall not be liable for any indirect, incidental, special, punitive or consequential damages, including loss of profit, loss of business, loss of goodwill, loss of opportunity or loss of data;
  • we shall not be liable for delays, missed connections, or any consequential expenses such as alternative travel arrangements, accommodation or meals, except as expressly provided in these Terms or required by law;
  • we shall not be responsible for the accuracy of fare, route or schedule information displayed on third-party platforms, aggregators or social-media handles that are not officially authorised by us.

Nothing in these Terms shall limit any liability that cannot be limited or excluded under applicable law, including liability for death or personal injury caused by our gross negligence or wilful misconduct.

15. Right to Refuse Carriage

Goldy Motors reserves the right, at its sole discretion and without liability, to refuse carriage to any person who:

  • does not produce a valid ticket or government-issued photo identification;
  • appears to be intoxicated or under the influence of any prohibited substance;
  • is suffering from a contagious illness that may pose a risk to other Passengers or Crew;
  • behaves in a disorderly, threatening, abusive or otherwise unsafe manner;
  • fails to comply with these Terms, the instructions of the Crew or applicable law.

16. Third-Party Services

Our Platform may contain links to, or rely on services from, third parties (including but not limited to PhonePe for payments and Google for map and location services). Your use of those services is governed by the respective third party's terms and policies, and we are not responsible for their content, accuracy, availability or security. You agree to read and abide by the terms applicable to those services where relevant to you.

17. Intellectual Property

All content on our Platform — including the Goldy Bus name, logo, trademarks, service marks, designs, layout, text, graphics, photos, videos, audio, illustrations, software, data and the "look and feel" of the website — is owned by, or licensed to, Goldy Bus Service and is protected by applicable intellectual property laws.

You are granted a limited, revocable, non-transferable, non-exclusive licence to access and use the Platform for the sole purpose of searching for, reviewing and making a Booking. You must not:

  • copy, reproduce, modify, distribute, publish, transmit, sell or commercially exploit any content from the Platform without our prior written consent;
  • reverse-engineer, decompile, disassemble or attempt to derive the source code of any part of the Platform;
  • scrape, crawl, harvest or otherwise collect any data from the Platform by automated means;
  • use the Platform to create a competing product, service, or data set.

18. User Submissions & Reviews

When you submit feedback, ratings, reviews, comments, photographs, videos or any other content ("User Content") to us, you grant Goldy Motors a non-exclusive, royalty-free, worldwide, irrevocable, perpetual, sub-licensable and transferable licence to use, reproduce, modify, adapt, publish, translate, display and distribute that User Content in any media, in connection with the operation and promotion of our Services.

You represent and warrant that any User Content you submit:

  • is yours, or that you have all rights necessary to grant us the licence above;
  • is accurate, not misleading, and does not infringe the intellectual property, privacy or other rights of any third party;
  • is not unlawful, defamatory, obscene, threatening, hateful, harassing or otherwise objectionable.

We reserve the right, but are not obliged, to monitor, edit or remove User Content at our sole discretion.

19. Indemnification

You agree to indemnify, defend and hold harmless Goldy Motors, its affiliates, owners, partners, officers, directors, employees, agents and Crew (the "Indemnified Parties") from and against any and all claims, demands, actions, losses, damages, costs and expenses (including reasonable legal fees) arising out of or in connection with:

  • your breach of these Terms or any policy referenced herein;
  • your violation of any law, rule, regulation or third-party right;
  • your User Content or any other content you submit to or through the Platform;
  • your wilful misconduct or gross negligence on board our buses or at our premises.

20. Privacy & Data Protection

The processing of your personal data in connection with these Terms is governed by our Privacy Policy, which is incorporated into these Terms by reference. Please read it carefully.

21. Governing Law & Jurisdiction

These Terms, and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims), shall be governed by and construed in accordance with the laws of India, without regard to its conflict-of-laws principles.

Subject to the dispute-resolution provisions below, the courts of competent jurisdiction at Shahjahanpur, Uttar Pradesh, India shall have exclusive jurisdiction over any dispute arising under or in connection with these Terms.

22. Dispute Resolution

In the event of any dispute, controversy or claim arising out of or relating to these Terms, the parties shall first attempt in good faith to resolve the matter amicably through discussions between an authorised representative of Goldy Motors and the Passenger.

If the dispute is not resolved within thirty (30) days of written notice, either party may refer the dispute to mediation or to the appropriate consumer-redressal forum, or pursue any remedy available under applicable law, subject to the jurisdiction stated above.

24. Severability & Waiver

If any provision of these Terms is held to be invalid, illegal or unenforceable by any court of competent jurisdiction, the validity, legality and enforceability of the remaining provisions shall not in any way be affected or impaired. Failure by Goldy Motors to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.

25. Changes to These Terms

We may revise these Terms at any time, in our sole discretion, to reflect changes in our Services, in our practices or in applicable law. The "Last updated" date at the top of this page indicates when the Terms were most recently revised. Material changes will be brought to your attention by reasonable means. Your continued use of our Services after any such change constitutes acceptance of the revised Terms.
